Earlier this week, Governor Christie signed legislation to prohibit the sale of unsafe, used tires.  NJGCA supported this legislation, in part because we know our members only sell the highest quality used tires, but there are many unscrupulous business owners out there who are willing to sell dangerous and unsafe tires at lower prices, undercutting our honest members. Additionally, with increased regulations on the sale of used tires, we anticipate an increase in the sale of new tires, which for our repair shops, generally leads to the added perk of service on suspension systems and front ends which accompanies new tires sales.

Reminder about the lawsuit that Speedway has filed, challenging the constitutionality of the Below Cost Selling law. NJGCA wants to show the State how important this law is to you and your business, so please join a group of NJGCA Board of Directors and our Association Attorney (Frank Brennan) at the hearing in Mercer County Superior Court on Friday, August 18th at 9 AM. Again, this case is strictly between Speedway and the State of New Jersey, but NJGCA wants to show our support for the Below Cost Selling law and encourage a strong defense of the law to protect our livelihoods.

Starting on Monday, August 14, NJGCA is offering the ETEP Re-Certification class for any Emission Repair Technicians who need to renew their licenses by taking Sections 8, 9 and 10 of the ETEP curriculum. Class is Monday and Wednesday, August 14th, 16th, 21st and 23rd from 2:00 PM to 9:00 PM.  For more information and to register for the class, please click HERE.

You should be receiving in the mail our annual Member Benefit Partner (MBP) Satisfaction Survey Please take the time to fill it out and let us know your comments and feedback on the Member Benefit Partners that you work with. Your opinions help us shape the program for next year and we want to make sure that our members are satisfied with the service and products that they receive from the companies that we recommend and trust. The survey is also available online HERE if you prefer to fill it out electronically and save postage! We will continue to ask you to fill this out throughout the coming months, so please do your best to share your thoughts and opinions to help make our Association and our Member Benefit Partner program even stronger and more valuable!

You will also continue to get reminders about our 80th Anniversary Gala. Some of you may even start getting phone calls. It is so important to us that our members attend this FREE event so we can all take a night off to enjoy and celebrate the accomplishments of this great organization. NEWS AROUND THE STATE: THE NEWS YOU SHOULD KNOW

08/09/2017:
2017 Tobacco Excise-Tax Scorecard
During 2017, legislative bills to raise cigarette and/or tobacco-product excise taxes were considered by 22 state legislatures. Oftentimes, more than one bill to increase these excise taxes was introduced in a given state, and the bills would have different amounts by which the current tax rates would be raised. Since 2017 is not an election year, the adoption of higher excise taxes is more likely. But only Delaware and Rhode Island have enacted higher cigarette and/or tobacco-tax increases, so far. In Delaware, the cigarette tax has been raised by 50¢ a pack to a new tax rate of $2.10/pack, the other tobacco product (OTP) tax was increased from 15% to 30%, and the tax on moist snuff was raised from 54¢ to 92¢. In Rhode Island, the cigarette tax is being raised 50¢ per pack to a new rate of $4.25/pack. This cigarette tax rate is the second highest in the country, next to New York State at $4.35/pack. In Minnesota, two excise-tax changes were enacted into law that are positive for the industry. The excise-tax cap on premium cigars was reduced from $3.50/cigar to 50¢ a cigar. Also, Minnesota law was changed to repeal the automatic annual increase in the cigarette tax.  Each January 1, the state cigarette tax increased automatically by a rate equivalent to the current consumer price index (CPI). This automatic tax inflator will no longer be in effect. The other states where cigarette and/or tobacco-tax increase bills were introduced but not adopted include Connecticut, Florida, Hawaii, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, Nevada, New Mexico, Oklahoma, Oregon, Utah, West Virginia, and Wyoming. States that have year-round legislative sessions that still have tax increase bills pending include Massachusetts and New York.

New Jersey Prohibits Sale of Unsafe Used Tires
NJ Governor Christie has signed legislation advocated by the U.S. Tire Manufacturers Association (USTMA) to prohibit the sale of unsafe, used tires that pose a risk to New Jersey motorists. Championed by Asw. Shavonda Sumter (D-Paterson) and Senator Nicholas Scutari (D-Linden), the new law imposes a fine on businesses selling tires that exhibit any one of several unsafe conditions such as worn-out tread, visible damage or improper repairs. “New Jersey has taken a bold step to protect motorists from high-risk, used tires that have no business being put back into service on NJ roads,” said Anne Forristall Luke, USTMA president and CEO. “We applaud Assemblywoman Sumter and Senator Scutari for their leadership on this important issue and we are grateful to Gov. Christie for signing this legislation.” In addition to the USTMA, the National Trade Association for Tire Manufacturers, the Tire Industry Association, and the New Jersey Gasoline-C-Store-Automotive Association (NJGCA) supported the legislation.

Sobering news for $15 minimum-wage boosters
EVIDENCE-BASED POLICYMAKING is a hot concept in government these days, but politicians still often draft legislation or propose regulations based on what they think voters will like — not the public interest as demonstrated by objective data. A notable exception has been the recent response of Montgomery County Executive Isiah Leggett (D) with regard to efforts by members of the County Council to raise the county’s minimum wage from the current $11.50/hour to $15/hour. In January, the Council voted 5-4 to raise the minimum wage to $15 by 2020, but Mr. Leggett vetoed the bill, citing cost increases to county government and the likely negative impact on the county’s economic competitiveness. However, advocates of a $15 minimum are trying again, with Council member Marc Elrich (D-At Large) recently introducing a bill slightly adjusted to address some of Mr. Leggett’s objections. Wisely, Mr. Leggett’s veto message called for an objective economic study of the probable consequences, intended and unintended, of the proposed hike -- which would leave Montgomery as the highest-minimum-wage jurisdiction in the area except for the District of Columbia. Proponents of the increase should have waited for the results of this study; they’ve just come in, and they vindicate Mr. Leggett’s caution. To read more about the findings of the study, click the link above.

MEMBER BENEFIT PARTNER MESSAGE BOARD:

TMP Energy Solutions

Another Way to Save on Your Energy Bills

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available.

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.

If you are interested in becoming part of this power purchase option, please contact Greg Cannon at the NJGCA.

Remember when you sign up your energy through the NJGCA Energy Program, TMP makes a considerable donation to the NJGCA Scholarship Fund through their proceeds. This has no affect on your rate, and costs you nothing out of pocket.

We hope to help hundreds of NJGCA members reduce their utility costs by participating in this and our other cost reduction programs.  Our purpose, in the endeavor, is to help NJGCA members lower their energy costs while supporting the NJGCA Scholarship Fund.

Contact GREG CANNON at 732-256-9646 or email Greg at greg@njgca.org. Mention that you are interested in saving money on your energy bills. NJGCA & TMP Energy Solutions will handle all the rest.

POLITICAL PARTICIPATON: THE NJGCA PAC

DEFENDING OUR MEMBERS.
PROTECTING YOUR INTERESTS.
ANSWER THE CALL & CONTRIBUTE TODAY!!

Promoting our agenda in Trenton is of utmost importance to NJGCA and our members.

However, in order to truly affect the debate, we must ensure our friends in the Legislature are re-elected. It is for this reason that your Association has established the NJGCA PAC.

For too long, the weight of funding our Political Action Committee, the arm of the Association responsible for political donations, has rested upon a few. This is not only unfair to those few members who have shouldered this burden, but means we are not utilizing our full strength to affect the debate in Trenton.

To truly understand the importance of supporting our allies, consider our successes in Trenton:

We defeated BELOW COST SELLING
We made history in getting FIRST RIGHT OF REFUSAL signed into law!
We have built large support for RIGHT TO REPAIR and got it passed out of the Assembly
We defended your small business against the false accusations of Attorney General Anne Milgram
We gained wide support to move New Jersey to an all PIF Inspection System and close the CIF lanes
...and MUCH MORE!!

In each instance, we achieved these goals with the help of our friends in the Legislature!

If every member contributes just $100.00 we will be able to provide the help necessary to ensure victory for our allies.

PLEASE SEND YOUR CONTRIBUTIONS TO:
NJGCA PAC
4900 Route 33 West, Suite 100
Wall Township, NJ 07753
Please make your donation payable to NJGCA PAC

I understand that times are tough for all NJGCA members, but this is just as important as any battle we have fought in the past.

We have made great progress in Trenton. I hope that you will answer the call.
