EXECUTIVE DIRECTOR'S MESSAGE: GREETINGS & SAL-UTATIONS!

PIFs BEWARE...COUNT YOUR STICKERS
IMPORTANT SURVEY REMINDER –TAKE IT NOW!
RETAILER CAUGHT CHEATING WITH AVIATION GAS IN HIS TANKS
TRENTON ACTION POSSIBLE - PLEASE STAND BY

It has recently come to our attention that some PIFs have not been receiving all of the inspection stickers that they orderedPLEASE double and triple check your orders, and make sure that the stickers are in the correct numerical order.  These stickers are not packaged by machines, and are subject to human error. It is up to you to ensure that you receive all of the stickers that you order, or else you will be subject to serious fines, penalties and license suspensions. You must account for ALL stickers when MVC auditors routinely visit your site.  If you encounter any inconsistencies, contact your nearest MVC Office IMMEDIATELY or call our office 973-376-0066 and ask for Debbie Hill to report any issues.

Remember, if your sticker order arrives with stickers missing, and you do not catch it at that time, you will be held responsible for the missing stickers.  It is not unusual for shop owners to simply take the package of stickers and lock them away where ever it is that they are normally stored without counting them.  Once you use them at a later date and find a missing sticker or a sticker number out of sequence, it is already too late, and it will be assumed that the sticker became missing while in your possession.

As you know, I recently met with Marc Ferzan and other members of the Governor’s Office of Recovery and Rebuilding to help the State better understand the causes of the massive gas lines that occurred after Hurricane Sandy. I promised to give the Governor’s staff detailed information on the circumstances that prevented consumers from being able to buy gas, and as we all know, for most stations it was more difficult to get a gas delivery than it was to get power restored. I am confident that as officials begin to understand the true causes of the gas lines, we will be able to avoid mandatory generators in gas stations.  But we need your help!  CLICK HERE TO TAKE THE SURVEY NOW!

Don’t expect this fight to go away!  Yes I feel confident that we will block this from happening, but there is constant pressure and debate among state officials that continually needs to be stopped.  Just pray another hurricane doesn’t blow thru NJ this summer and leave multitudes of gas stations without power, while refineries, pipelines, and distribution racks remain undamaged and able to deliver gasoline to all locations.  A circumstance like that will end my arguments and blow me out of the State House.  Right now, my arguments are backed up with solid evidence that shows generators would have been of no help in the aftermath of Hurricane Sandy.

I continue to hammer away at the burdensome cost that you will have to endure, SO PLEASE CLICK HERE TO TAKE THE SURVEY NOW!

Earlier this week, the Attorney General’s Office released a statement indicating that it had filed a lawsuit against six gas stations for selling Aviation Fuel (Avgas) to consumers who thought they were filling their vehicles with gasoline.  You can read the Attorney General’s press release by CLICKING HERE.

Unlike unleaded motor fuel, Avgas contains tetraethyl lead, a substance that has been banned because it can damage catalytic converters and oxygen sensors. The Attorney General is pursuing restitution for anyone who can show that their vehicle was damaged by these unlawful practices.  There are two lessons to learn here.

1. Don’t be stupid, if someone offers to sell you gasoline at a ridiculously low price, and it sounds too good to be true, it probably is.

2. Always check your bill of lading to ensure that you are receiving the proper delivery.  If somebody else made an error, you don’t want to be the one held accountable.

Frankly, I am concerned with another part of this picture that is disturbing.  The distributor that owns the locations where the Avgas was delivered was operating several of the locations as a major branded station.  Since he was picking up and delivering product that was not the major brand product, then he was cheating both his customers and all of you who buy that major brand at a much higher price.  He claims that he thought it was gasoline and was unaware that it was Avgas, but he certainly knew it was not the brand that he should have been hauling.  This does not sit well with me and I plan to ask authorities to charge him with fraud in this regard as well.  Remember…NJGCA has a zero tolerance policy when it comes to co-mingling branded and unbranded product.  That is CHEATING!

As you may know, the deadline to opt-out of the settlement agreement with Visa and MasterCard has passed.  It is my sincere hope that you chose to protect yourself and your business by opting-out and retaining your right to suit Visa and MasterCard in the future.  Since the deadline passed earlier this week, a number of large retailers such as Target, Macy’s, Saks, Kohl’s and others have already re-filed against Visa and MasterCard.  These predatory and abusive credit card surcharges will continue, and we must never forfeit our right to challenge the unfair credit card fees these companies charge.  We must hold them accountable!

There were some rumblings in Trenton today that may cause me to be sending some Wildfire Alerts next week.  Right to Repair may be scheduled for a committee hearing as well as several other important bills.   I don’t want to be premature so I will simply ask you to be on standby.

Thanks for reading – See you next week!

Regards,
Sal Risalvato
Executive Director

NEWS AROUND THE STATE: THE NEWS YOU SHOULD KNOW

05/30/2013:
NJ Breaks Record for Snow Removal Costs
Despite relatively low snowfall totals, the state Department of Transportation spent a record $62 million fighting snow and ice for the winter of 2012-13. One factor in the higher costs was an increase in the average pay rate for the 1,700 contractors who help the DOT plow and spread salt, from $137.62 per truck per hour to $172.15.  The costs rose for the contractors because they were in demand from malls and private office parks, officials said. Close to half of the snow-fighting total was contractor costs. The DOT spread nearly three times as much salt as last year, more than three times as many gallons of liquid calcium chloride and nearly twice as many gallons of brine, officials said.

05/29/2013:
US shale production threatens to divide Opec
US shale oil production has reduced the import needs of Opec’s largest customer (the US) to the lowest levels since 1994, and has raised the prospect of lower prices. Though the Opec oil cartel is set to keep its production target unchanged, the impact of the US’ shale mining and resulting decrease in imports falls mostly on the African oil producers, such as Nigeria, as opposed to the Gulf states, like Saudi Arabia. As such, while a Saudi oil minister went out of his way to welcome increased US oil production, his Nigerian counterpart said the shale oil revolution was “one of the most serious threats” for the group.

05/25/2013:
NJGCA in the News: Editorial submitted on tobacco bill’s imposition on shop owners
In last week’s Road Warrior, we mentioned our opposition to Senator Codey’s proposal to raise the legal purchase age for tobacco. On Saturday, an NJGCA letter to the editor was published in the Times of Trenton, briefly outlining our argument once again.  Please refer to the article above to familiarize yourself with our position!

05/24/2013:
Generator mandates becoming a reality in New York
In an effort to thwart the possibility of another fuel crisis similar to the one that paralyzed New York and New Jersey in the wake of Superstorm Sandy, the state of New York recently imposed a generator-readiness mandate on gas stations located within a half mile of limited-access highway exit roads or evacuation routes. The New York Association of Convenience Stores (NYACS) supports the new legislation because it provides retailers with more financial and logistical support to meet the requirements.  Please read the above article to learn more about exactly what will be required and what kind of financial assistance is available through this legislation.

MEMBER BENEFIT PARTNER MESSAGE

TMP Energy Solutions
Another Way to Save on Your Energy Bills

We have had a number of NJGCA members successfully reduce their rate per kWh   signing up through our energy saving program. We know it’s difficult to collect 12 months worth of previous electric bills to get an “accurate” analysis when comparing a variable rate to a fixed rate, but we now have another option available.

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum KW demand is acquired. By pooling the member’s usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #’s, meter #’s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.

If you are interested in becoming part of this power purchase option, please contact Greg Cannon at the NJGCA.

Remember when you sign up your energy through the NJGCA Energy Program, TMP makes a considerable donation to the NJGCA Scholarship Fund through their proceeds. This has no affect on your rate, and costs you nothing out of pocket.

We hope to help hundreds of NJGCA members reduce their utility costs by participating in this and our other cost reduction programs.  Our purpose, in the endeavor, is to help NJGCA members lower their energy costs while supporting the NJGCA Scholarship Fund

Contact GREG CANNON at 973-376-0066 or email Greg at greg@njgca.org. Mention that you are interested in saving money on your energy bills. NJGCA & TMP Energy Solutions will handle all the rest.

POLITICAL PARTICIPATON: THE NJGCA PAC

DEFENDING OUR MEMBERS.
PROTECTING YOUR INTERESTS.
ANSWER THE CALL & CONTRIBUTE TODAY!!

Promoting our agenda in Trenton is of utmost importance to NJGCA and our members.

However, in order to truly affect the debate, we must ensure our friends in the Legislature are re-elected. It is for this reason that your Association has established the NJGCA PAC.

For too long, the weight of funding our Political Action Committee, the arm of the Association responsible for political donations, has rested upon a few. This is not only unfair to those few members who have shouldered this burden, but means we are not utilizing our full strength to affect the debate in Trenton.

To truly understand the importance of supporting our allies, consider our successes in Trenton:

We defeated BELOW COST SELLING
We made history in getting FIRST RIGHT OF REFUSAL signed into law!
We have built large support for RIGHT TO REPAIR and got it passed out of the Assembly
We defended your small business against the false accusations of Attorney General Anne Milgram
We gained wide support to move New Jersey to an all PIF Inspection System and close the CIF lanes
...and MUCH MORE!!

In each instance, we achieved these goals with the help of our friends in the Legislature!

If every member contributes just $100.00 we will be able to provide the help necessary to ensure victory for our allies.

PLEASE SEND YOUR CONTRIBUTIONS TO:
NJGCA PAC
66 Morris Avenue
Springfield, NJ 07081
Please make your donation payable to NJGCA PAC

I understand that times are tough for all NJGCA members, but this is just as important as any battle we have fought in the past.

We have made great progress in Trenton.  I hope that you will answer the call.
