Last week I mentioned that I was waiting for a good time to update you on a few things. I’ve only made brief mention here and there because of the behind-the-scenes nature of our efforts and I chose not to raise any flags on these sensitive issues because I did not want to stir up any opponents.
 
However, I can now discuss our work on a bill concerning excessive price increases (aka price gouging) during a State of Emergency.  Few people besides myself and Eric DeGesero of the Fuel Merchants Association of New Jersey (FMANJ) are aware of the amazing fact that NONE OF THE CHRIS CHRISTIE DECLARED STATES OF EMERGENCIES SINCE HURRICANE IRENE HAVE BEEN RESCINDED. Every time there is a snowstorm or a potential hurricane, Governor Christie has declared a “new” State of Emergency, even though the old ones have never been terminated.  Since Hurricane Irene there have been about 15 States of Emergency declared, including the time that the Pope visited Philadelphia and there was an expected traffic nightmare in NJ’s bordering counties. Of the 15 declared, zero were rescinded after the 'emergency' had concluded.
 
There are two questions that you should be asking:
  1. Why should I care that a State of Emergency is never terminated, and continues to remain in effect for months, and years after the event?
  2. Why would Governor Christie not terminate a State of Emergency? Technically, we are living in a perpetual State of Emergency.
The answer to question #2 is technical and complicated.  It has to do with municipalities not being able to apply for federal aid for any infrastructure damage discovered after a State of Emergency has ended for a particular storm. A municipality IS able to get federal aid if the State of Emergency is still in effect, but once it is terminated, the municipality would NOT have access to federal aid funds. So, on a technicality, this is a way for municipalities to keep their foot in the door in case they discover road or bridge damage that resulted from a hurricane or storm that occurred months or years prior.
 
The answer to the first question, “why should I care” is because each time there is a State of Emergency in effect, gouging laws are also in effect!! According to NJ State Law, you are in violation of the gouging statute if you increase your price more than 10% of what it was on the day that the State of Emergency went into effect.  This applies to any and all price changes that you make for a full month (30 days) after the State of Emergency.  Since the last 15 States of Emergency have not been terminated, this means that NJ has been in a perpetual State of Emergency for 6 years, and gouging rules have applied to you that entire time!!
 
Eric DeGesero and I brought this issue to the attention of the previous Director of Consumer Affairs, Eric Kanefsky. We've had a gentleman’s agreement for some time, in which the Director promised us that they are aware of this troubling situation, and nobody from Consumer Affairs would try to play “gotcha” with my members. So far, they have kept their end of the bargain. However, we don't have the same confidence that future Governors and future Directors of Consumer Affairs will also honor this verbal agreement. 
 
As such, a coalition of organizations has worked quietly for over a year to pass legislation that essentially says, “price gouging laws are no longer in effect 30 days after the declaration of the State of Emergency, unless specifically extended by the Governor.” This bill just passed the Senate on Monday afternoon. We have not engaged members on this because we are looking to keep any press attention off the issue and we have just been working quietly on getting it passed and signed, hopefully in the next few months.
 
Next, because gasoline and all other fossil fuel energy prices have been so low in recent years, very little attention has been paid to alternate fuels for motor vehicles.  You may remember that several years ago I discussed this often, and NJGCA even sponsored a forum on Natural Gas Vehicles.  Although not much attention has been paid to this issue, it has not died, nor do I expect that it ever will.  It is important that, as part of my job, I keep reminding you that you are not just in the gasoline and diesel business, or the gasoline and diesel repair business. You are in the transportation energy business and the transportation repair business.  It is important that you pay attention to what lies ahead in the future. 
 
On Monday, I testified in support of a bill that will form a public-private partnership between the Board of Public Utilities (BPU) and private fuel retailers to encourage the installation of level 3 fast charging electric charging stations, which are expensive but can charge an electric vehicle in about 15 minutes.
 
This is important to NJGCA members for several reasons.  When a customer recharges at your location, there is a good ten minute period that they can spend in your store, buying coffee or sandwiches.  They will also get the opportunity to feel comfortable that your repair shop can service their electric vehicle – because EVs need service too! 
 
It’s important for you to understand that if you do not, at some point in the future, cater to motorists who drive electric vehicles or natural gas vehicles, these are customers that you’ll never see again.  Although this legislation is only a beginning and has a long way to go before it gets to the Governor’s desk, I do believe that it will eventually be passed and I will keep you updated as it progresses.
 
We still haven’t been talking much about State Inspections. The whole process has been very frustrating to us. The only thing we’ve learned is that the current Parsons contract has been extended to November of 2017, which is actually in violation of state law. Nobody is sharing information with us, and everything that we are learning is behind-the-scenes from our contacts who do not want to be identified.  If there is more news, we’ll share it with you.
 
Finally, we are two weeks out from our Gas and C-Store Summit and we are going to continue to remind you (probably every day) about the event!  There is something for everyone at this Summit!!  ALL small businesses are affected by items such as credit card fees, skimming, $15/hour minimum wage, and mandatory paid sick leave.  ALL businesses could benefit from saving money on health coverage, workers compensation and liability insurance, and even earning dividends at the end of the year!

For people in the gasoline and c-store industries, we will have officials from Weights and Measures, DEP and OSHA to discuss items specific to your businesses.  And, of course, we are thrilled that
Lieutenant Governor Kim Guadagno will be our Keynote Speaker!!

The largest oil deposit ever found in America was just discovered in Texas
The US Geological Survey found what could be the largest deposit of untapped oil ever discovered in America. An estimated average of 20 billion barrels of oil and 1.6 billion barrels of natural gas liquids are available in the Wolfcamp shale, in the Midland Basin portion of Texas' Permian Basin. Based on a West Texas Intermediate crude oil price of $45/barrel, those deposits are worth about $900 billion. US oil exploration companies have flocked to the superrich Permian Basin in recent years and used shale-drilling technology to create an oil boom that simultaneously helped trigger a price crash two years ago. The count of active oil rigs fell with prices, but has risen over the past few months, mostly in the Permian. Bloomberg noted that the Wolfcamp, where this deposit was found, has been one of the primary targets of shale drillers. "The fact that this is the largest assessment of continuous oil we have ever done just goes to show that, even in areas that have produced billions of barrels of oil, there is still the potential to find billions more," Walter Guidroz, program coordinator for the USGS Energy Resources Program, said in a statement.

Looking Beyond Tobacco Tax Decisions
Tobacco-session panelists at Winsight's recent Outlook Leadership Conference in Scottsdale, Ariz asked retailers to keep active, advising they get behind an emerging federal proposal to help ease FDA “deeming” regulations. Referring to the Cole-Bishop amendment to the House agricultural budget bill, John Hoel, director of federal government affairs for Altria Client Services, Richmond, Va., told about 75 attendees that the measure would ease application requirements for any number of newly deemed products (such as vapor, cigars, etc.) brought to market after 2007. The measure would move the so-called “predicate date,” or cutoff for new products to undergo an onerous application process with the US Food and Drug Administration (FDA), Washington, D.C., possibly to Aug. 8, 2016. If passed, the measure would grandfather in many products, especially those in the vapor category, providing them a less complex path to FDA approval. Much of that legislative discussion over budgets is scheduled for this fall. In terms of tax battles on the ballot, Kerry Paulson, regional director of the Eastern region for Altria, said 3/4 measures to raise state cigarette taxes failed, with approval occurring in California, where the taxes will increase $2 per pack to $2.87.  Proposed tax increases failed in Colorado, Missouri and North Dakota.

BP Stations Testing Fuel Pumps with Personality
BP’s new interactive fuel pump -- affectionately dubbed “Miles” -- made its official debut at the BP station on the busy corner of Wells Street and Chicago Avenue in Chicago. Developed through a partnership with The Onion and Pandora, Miles uses interactive technology to audibly greet customers when they approach the pump, then lets them select music on Pandora, record a video e-card to share on social media, or play music trivia — all in real-time via a touchscreen tablet that guides them through the array of entertainment options. After pumping gas with Miles, drivers can send themselves a text message with the content they created while at the pump, a link to their chosen Pandora station, plus special offers such as a 25-cent discount on a gallon of BP gas on a future visit.  BP will test the new “Miles” pump technology — the first significant pump innovation since pay-at-the-pump was popularized in the 1980s — for three months, according to Doug Dryan, BP’s consumer advertising manager. “The pumps will be up through Feb. 14, 2017 — one in Chicago; one in Naperville, Ill.; and two in Brooklyn, N.Y.,” Dryan shared at the Chicago launch.

Estate tax cut already changing CPAs’ advice to flee NJ
About 75% of certified public accountants in New Jersey have advised clients to leave the state because of the estate and inheritance taxes, according to the head of the New Jersey Society of CPAs. That tax is ending – and so is the advice, even before the law is off the books, said Ralph Albert Thomas, the CPA group’s chief executive officer and executive director. “Not only our members, but I know estate attorneys have been sending out correspondence about, look, they need to reconvene with their clients to relook at what they proposed,” Thomas said. The survey found 83% of respondents felt estate and inheritance taxes had prompted clients to leave New Jersey. A follow-up survey is planned for the spring, to see how much the advice has changed. The estate tax is paid on approximately 3,500 estates annually, around 5% of the approximately 70,000 deaths in the state each year. Currently, New Jersey’s estate tax threshold is $675,000.  The full value of any estates worth more than that is taxed.  That will be changed to a $2 million exclusion at the start of 2017 – meaning, for instance, that an estate worth $2.5 million would be taxed on the $500,000 over the excluded amount. The tax is then eliminated entirely at the start of 2018.  The inheritance tax isn’t being altered.  Thomas said there was a limit to how much could be changed at once.

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.
